SMS Terms and Conditions

These SMS Terms and Conditions ("SMS Terms") govern your enrollment in and receipt of text messages from SofiaRX LLC ("SofiaRX," "we," "us," or "our"). By opting in to any SofiaRX SMS program, you agree to these SMS Terms.

1. SMS Programs

SofiaRX operates the following text messaging programs:

1.1 Transactional & Clinical Notifications (Program: SOFIARX-CARE)

These messages support the delivery of your care and subscription services. They may include:

  • Prescription status updates (e.g., clinician review complete, prescription sent to pharmacy)
  • Shipment and delivery notifications for your medications and lab kits
  • Lab result availability alerts ("Your lab results are ready in your portal")
  • Subscription billing reminders and renewal notifications
  • Care team follow-up prompts
  • Protocol check-in reminders (e.g., weekly dose reminders)
  • Account and security alerts (e.g., password reset, login verification)

Message frequency: Varies based on your order and protocol activity. Typically 2–6 messages per month, and up to 2 per day during active shipment or onboarding periods.

1.2 Marketing and Promotional Messages (Program: SOFIARX-PROMO)

These messages may include promotional offers, new product announcements, health tips, and other marketing communications from SofiaRX.

Message frequency: No more than 4 messages per month.

Note: Enrollment in SOFIARX-PROMO is optional and separate from transactional messaging. You may opt out of marketing messages without affecting delivery of clinical and service notifications.

2. How to Opt In

Transactional & Clinical Messages (SOFIARX-CARE)

You opt in to transactional and clinical text messages when you:

  • Provide your mobile phone number during account registration or intake and check the box indicating your consent to receive text messages; or
  • Provide your mobile phone number to your care team and consent to receive text updates.

Marketing Messages (SOFIARX-PROMO)

You opt in to marketing text messages by:

  • Checking the designated opt-in box during account registration or in your account Settings.

Your consent to receive marketing text messages is not required as a condition of purchasing any SofiaRX product or service.

3. How to Opt Out

Opting Out of All SofiaRX Text Messages

To stop all text messages from SofiaRX, reply STOP to any SofiaRX text message at any time. After we receive your STOP request, we will send a one-time confirmation message and then stop sending messages to that number. You can re-enroll at any time by following the opt-in steps above.

Opting Out of Marketing Messages Only

To stop marketing messages while continuing to receive clinical and transactional notifications, reply STOPPROMO to any marketing message, or update your communication preferences in your account Settings under Settings > Notifications.

Effect of Opting Out

Opting out of text messages does not cancel your SofiaRX subscription. You will continue to receive important communications via email, including prescription notifications, billing statements, and care team messages. To manage your email preferences, log in to your portal and go to Settings > Notifications.

5. Message and Data Rates

Message and data rates may apply.SofiaRX does not charge you for text messages, but your mobile carrier may charge standard text messaging and data rates. Contact your mobile carrier for information about your plan's messaging rates.

6. Supported Carriers

SofiaRX's SMS programs are available on most major U.S. wireless carriers, including (but not limited to): AT&T, Verizon, T-Mobile, US Cellular, Sprint, Boost Mobile, Cricket Wireless, and Metro by T-Mobile. Service may not be available on all carriers or in all areas. Carrier support may change without notice.

7. HIPAA and Health Information in Text Messages

SofiaRX does not send Protected Health Information (PHI) in standard text messages. Text messages from SofiaRX are limited to:

  • Status notifications (e.g., "Your prescription is ready") that direct you to your secure patient portal for detailed information;
  • Administrative alerts (e.g., billing reminders, shipment tracking); and
  • General health coaching prompts that do not contain individually identifiable health information.

Detailed clinical information — including lab results, prescription details, and clinician notes — is available only through your secure patient portal at sofiarx.com/portal. If you receive a text message that appears to contain detailed clinical information, please contact us at legal@sofiarx.com.

Your health information is protected under HIPAA and our Notice of Privacy Practices.

8. Privacy

Your mobile phone number and messaging preferences are handled in accordance with our Privacy Policy. We do not sell your mobile phone number to third parties for their marketing purposes. We may share your number with our SMS platform provider(s) solely to facilitate message delivery; such providers are contractually restricted from using your number for any other purpose.

9. Consent Is Not a Condition of Purchase

Your consent to receive marketing text messages is never requiredas a condition of purchasing or receiving any SofiaRX product or service. You may use SofiaRX's services without enrolling in the SOFIARX-PROMO program.

Enrollment in SOFIARX-CARE transactional messaging is part of your service agreement, as these messages relate directly to the delivery of your care. However, if you prefer not to receive transactional texts, you may opt out and receive equivalent notifications by email.

10. Changes to These SMS Terms

We may update these SMS Terms from time to time. The "Last Updated" date at the top reflects the most recent revision. Material changes will be communicated by text message, email, or by posting a notice on our website. Your continued enrollment in any SofiaRX SMS program after the effective date of any changes constitutes acceptance of the updated SMS Terms.
